  4. My nerd response to the Duse: The Baltimore Police Dept. will be vicariously liable for any law suit damages because Rivieri was acting within the scope of his employment.

  6. Huh? Who writes that and doesn’t expand on why? I’m pretty sure what I said is “necessarily” true unless there is some state law that shifting municipal/police liability, which is unlikely. Rivieri may be fired, but the Department will pay for the damages he caused.

  7. Because A) it’s more complicated than that, and B) explaining civ lib litigation pro bono isn’t my style. Plus I don’t work for gays.
